Thank you for shopping at Feng Shui Mind of South Florida, if you visit our site and/or buy our Products or Services you agree to the following Terms and Conditions:

PRIVACY NOTICE:

When ordering Products or Services from Feng Shui Mind of South Florida, Feng Shui Mind of South Florida requires Customer to provide Customer’s name, email address and mailing address. When ordering Services Feng Shui Mind of South Florida requires Customer to provide additional personal information needed to deliver the Services; all information is confidential and Feng Shui Mind of South Florida agrees not to share it with any third party without Customer’s written consent.

Feng Shui Mind of South Florida forwards Customer to Paypal for payment processing under secure internet conditions.

On a regular basis Feng Shui Mind of South Florida might contact Customer via e-mail to communicate updates on Products, Services and Events.

COPYRIGHT

Feng Shui Mind of South Florida possesses full ownership and/or rights of use of all designs, texts, and arrangements at www.fsosf.com web site. The use of materials in the web site for purposes different from placing purchase orders of Products and Services is strictly prohibited.

ACCEPTANCE OF ORDER

Feng Shui Mind of South Florida reserves the right to accept or reject any order for Products or Services from a Customer. No order is binding on Feng Shui Mind of South Florida until accepted.

CANCELLATION OF ORDERS

If a Customer cancels an order for any Product(s) or Service(s) that has been accepted by Feng Shui Mind of South Florida, the Customer must give written notice to Feng Shui Mind of South Florida at contact_us@fsosf.com no later than twenty four (24) hours after placing the order.

RETURN POLICY

Customer shall be deemed to have accepted the Products unless, within seven (7) days after the receipt of the shipment, Customer notifies Feng Shui Mind of South Florida in writing at contact_us@fsosf.com that Customer rejects the particular Product(s).  The rejection notice must advise Feng Shui Mind of South Florida the specific reason for rejection. After Feng Shui Mind of South Florida has reviewed the notice and authorized the return providing a return material authorization (RMA), Customer shall return the Product(s) to Feng Shui Mind of South Florida in the same condition as when Customer received them. Freight charges are not refunded and the Product(s) to be returned by Customer must be shipped freight prepaid.  Feng Shui Mind of South Florida reserves the right to make partial refunds of the price of the Product(s) not returned as new in their original selling and packing conditions. Refunds are processed through Paypal.

PRODUCTS

Feng Shui Mind of South Florida may modify the design or materials of the Products without any liability or obligation to Customer, including, without limitation, any obligation to modify any Product previously ordered by Customer.  Feng Shui Mind of South Florida does not warrant to Customer the continued availability of any of the Products, and Customer hereby expressly releases Feng Shui Mind of South Florida from liability for any loss or damage to Customer arising out of or by virtue of the failure of Feng Shui Mind of South Florida to accept or fill any orders due to particular product shortages or general product unavailability.

TAXES

Unless otherwise specified, the prices quoted for any Products provided herein are exclusive of any amount for governmental taxes and any amount of customs, taxes, fees or similar costs relating to the purchase of the Products, their import into, and use within the country designated by the Customer other that the United States of America. If any taxes are determined applicable to this transaction or Feng Shui Mind of South Florida is required to pay or bear the burden thereof, the Customer agrees to pay to Feng Shui Mind of South Florida the amount of such taxes and any interest or penalty thereon no later than thirty (30) days after receipt of an invoice therefor.

Customer is responsible for paying to the government of the country where Customer has its place of business as named herein, any amount withheld pursuant to the tax or other laws, regulations and instructions of the said government, or any department, agency, or authority thereof.

PRICES

Unless otherwise agreed in writing, the prices quoted to the Customer shall be valid for a limited period of no more than thirty (30) days.

PAYMENT TERMS

Unless otherwise agreed in writing, payment for Products shall be made by Customer to Feng Shui Mind of South Florida in US Dollars.

All purchases shall be paid to Feng Shui Mind of South Florida.

If Customer fails to pay any invoice for Products or Services, Feng Shui Mind of South Florida shall have the right, in addition to its other rights hereunder, to cancel any Customer order(s) for Products or Services, or to delay any further delivery of Products or Serivces to Customer, without incurring any liability for loss or damage of any kind occasioned by reason of such cancellation or delay.

Any invoiced amount which is not paid in accordance with the terms and conditions as agreed shall be considered past due. Feng Shui Mind of South Florida shall be entitled to past-due interest on the overdue balances outstanding at the maximum interest permitted by law per month.  Any interest on such past-due accounts shall become due and payable immediately and Customer shall be responsible for payment of any withholding tax due thereon. Customer shall be liable to Feng Shui Mind of South Florida for all legal costs, fees and expenses incurred in securing payment of all sums owed.

LIMITATION OF LIABILITY

Feng Shui Mind of South Florida total liability is limited to five percent (5%) of the price of the particular products sold hereunder with respect to which losses for damages are claimed.  Customer’s sole remedy is to request Feng Shui Mind of South Florida at Feng Shui Mind of South Florida option to either refund the purchase price, repair or replace Product(s) that are not as warranted.

In no event will Feng Shui Mind of South Florida be liable for any loss of use, loss of time, inconvenience, commercial loss, lost profits or savings or other incidental or consequential damages to the full extent such may be disclaimed by law.

FORCE MAJEURE

Neither Feng Shui Mind of South Florida nor the Customer shall be responsible for delays or lack of performance resulting from events of force majeure which shall inlcude but not limited to fire, flood, epidemic, earthquake, storm, tidal wave or other acts of nature; riot, war, hostility, public disturbance or acts of public enemies; strikes or other labor disputes or work stoppages; prohibitions by or acts of governments or public agencies; failure or interruption of transportation or other utilities; and all unforeseeable events beyond the reasonable control of the parties, including events recognized as Force Majeure in general international commercial practice.

If an event of Force Majeure occurs, a party’s contractual obligations affected by such an event, shall be suspended during the period of delay caused by the Force Majeure and shall be automatically extended, without penalty, for a period equal to such suspension.

The party claiming Force Majeure shall promptly inform the other party in writing and shall furnish within fifteen (15) days thereafter sufficient proof of the occurrence and duration of such Force Majeure.

In the event of Force Majeure, the parties shall immediately consult with each other in order to find an equitable solution and shall use all reasonable endeavors to minimize the consequences of such Force Majeure.

DELIVERY

Most Products are delivered through UPS (United Parcel Service). Damage is unlikely to happen but Customer is responsible for checking the Product(s) upon delivery and contact Feng Shui Mind of South Florida immediately at contact_us@fsosf.com in case of damage to determine if damage was originated during transportation or before Product(s) were shipped to Customer’s address.

SHIPMENT DATES

Delivery dates and schedules for Products and Services are conditioned upon Customer’s performance of its obligations in a timely manner, which will include furnishing an acceptable and complete order to Feng Shui Mind of South Florida, and providing, upon Feng Shui Mind of South Florida request, any additional information as Feng Shui Mind of South Florida deems necessary. Feng Shui Mind of South Florida may reasonably delay the scheduled delivery date and will notify Customer promptly of that delay. Feng Shui Mind of South Florida shall not be liable to Customer for any expense, loss or damage caused by such delay.

WARRANTIES

Feng Shui Mind of South Florida represents and warrants that all Products sold and delivered to Customer conform in design, materials and workmanship to the appropriate specifications and can be returned within seven (7) days of the Products’ receipt date.

Watches are warranted to be free from manufacturing defects for 12 months from the original purchase date. Crowns, cases, crystals, straps, bracelets, batteries, accidents or abuse are excluded from this warranty.

Services are not guaranteed, all Customers can benefit from Chinese metaphysic related services like feng shui but not all do it to the same extent.

The express warranties contained in this Paragraph are given in lieu of all other warrantities, express or implied, which are specifically excluded without limitation, the implied warranties of merchantability and fitness for a particular purpose.
